Legacy Property Clinic
Terms of the Legacy Property Clinic Donation Programme
Operated by Probate.Auction Ltd in association with The Institute of Legacy Management.
1. Introduction
These terms and conditions (“Terms”) govern participation in the Legacy Property Clinic Donation Programme (“Clinic”) operated by Probate.Auction Ltd (“Probate.Auction”, “we”, “us” or “our”).
The Legacy Property Clinic is an advisory-led property review service created to assist charities, legacy teams and authorised representatives dealing with difficult, delayed or complex property matters.
By submitting a property through the Legacy Property Clinic submission form or designated submission channel, you confirm that you have read and accepted these Terms.
Our Privacy Policy and Website Terms also apply and should be read alongside these Terms.
2. Purpose of the Clinic
The Clinic has been established to:
- review challenging legacy and probate property cases;
- provide guidance on possible disposal strategies;
- assess whether auction may be an appropriate route;
- support charities dealing with difficult or underperforming property assets.
The Clinic is advisory in nature only.
Submission of a property does not create any obligation to proceed with Probate.Auction services and does not guarantee that auction will be recommended.
3. Eligibility
Participation in the Clinic is available to:
- UK registered charities;
- legacy teams;
- professional representatives;
- executors;
- solicitors;
- or individuals authorised to act on behalf of a charity or estate.
By submitting a property, you confirm that:
- you are aged 18 years or over;
- the information provided is accurate to the best of your knowledge; and
- you are authorised to provide the property details submitted.
We reserve the right to request further information or proof of authority where appropriate.
4. Eligible Property Criteria
Properties submitted to the Clinic may be considered eligible where they include one or more of the following characteristics:
- prolonged time on the market;
- unmodernised or poor condition;
- short lease;
- structural concerns;
- title or legal complexity;
- tenanted occupation;
- previous sale fall-throughs;
- difficult location or restricted buyer demand;
- probate-related delay or complexity;
- or other saleability concerns.
Eligibility is determined at the sole discretion of Probate.Auction.
We reserve the right to decline or refuse any submission for any reason.
5. £20 Submission Donation
For each eligible property submitted through the Clinic, Probate.Auction will donate £20 to the submitting or lead charity.
The £20 donation:
- applies only to eligible submissions accepted into the Clinic review process;
- is limited to one donation per property submission; and
- will normally be processed within 30 days of review acceptance.
We reserve the right to withhold donations where duplicate, misleading, incomplete or ineligible submissions are made.
6. £400 Successful Sale Charity Donation
Where a property reviewed through the Clinic proceeds to a successful auction sale through Probate.Auction, Probate.Auction will donate £400 to the lead or introducing charity.
For the purposes of these Terms:
- a “successful auction sale” means a legally binding exchange of contracts through Probate.Auction;
- the property must have first been introduced through the Clinic submission process; and
- the donation becomes payable only following successful exchange of contracts and receipt of the buyer’s deposit.
Only one £400 donation shall apply per completed property transaction.
7. £100 ILM Donation
For every property reviewed through the Clinic that proceeds to a successful auction sale through Probate.Auction, Probate.Auction will donate £100 to ILM.
The ILM donation is payable only following successful exchange of contracts.
8. Advisory Nature of the Clinic
Probate.Auction may recommend:
- auction sale;
- open market sale;
- repricing;
- alternative disposal strategies;
- or no action.
Any guidance provided through the Clinic is for general advisory purposes only and should not be relied upon as legal, financial or tax advice.
Independent professional advice should always be obtained where appropriate.
9. Submission Process
To participate in the Clinic, you must complete the relevant submission form and provide all reasonably requested information relating to the property.
We are not responsible for:
- incomplete submissions;
- technical failures;
- corrupted data;
- or unsuccessful transmission of information.
We may share property details with professional advisers, auction partners or third-party service providers where reasonably necessary for the purposes of reviewing or progressing the property.
10. General Conditions
Probate.Auction reserves the right to:
- amend;
- suspend;
- withdraw;
- or terminate the Clinic or Donation Programme at any time without notice.
Donations:
- are discretionary;
- non-transferable;
- and carry no cash alternative.
Nothing within these Terms creates:
- any partnership;
- agency relationship;
- exclusivity arrangement;
- or obligation to proceed with a transaction.
11. Limitation of Liability
To the fullest extent permitted by law, Probate.Auction shall not be liable for:
- indirect or consequential loss;
- loss of opportunity;
- loss of profit;
- or any loss arising from participation in the Clinic or reliance on advisory guidance provided.
Nothing within these Terms limits liability for fraud, fraudulent misrepresentation or any liability which cannot lawfully be excluded.
12. Confidentiality & Data Protection
Any personal information submitted through the Clinic will be handled in accordance with our Privacy Policy.
By participating in the Clinic, you consent to Probate.Auction processing and storing submitted information for the purposes of:
- property review;
- communication;
- advisory assessment;
- and transaction administration.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction in relation to any dispute arising under these Terms.
